Mortgage Forgiveness Debt Relief

Statement on President Bush's Signing of Mortgage Forgiveness Debt Relief By NAR President Richard F. Gaylord
WASHINGTON, December 20, 2007 - 

“On behalf of the many individuals and families who would have been burdened by a tax after losing their home, the National Association of Realtors® thanks President George W. Bush for signing the Mortgage Forgiveness Debt Relief Act into law. Today the president offered a Christmas present to many people who have suffered the agony and humiliation of losing their home due to a short sale, foreclosure, deed in lieu of foreclosure or any similar arrangement that relieves the borrower of the obligation to pay some portion of their debt.

“NAR has been advocating for such a change to the IRS tax code for nearly 10 years. We have always believed that it is clearly an issue of fairness and of not kicking people when they are down. By making the forgiven debt taxable income, individuals in already unfortunate situations most likely faced IRS actions because they did not have the money to pay the additional taxes. This legislation will relieve that additional burden and may also encourage families to work with their lender to negotiate terms, knowing they will now not be subject to an IRS bill.

“Today’s bill will ensure that any debt forgiven on a mortgage secured for a principal residence will not be taxed. This is very significant legislation. This may also mean that some day in the future these families can once again achieve the dream of homeownership.”

It is always best to check with a tax person and have them explain just how it will work in your case.

Making a offer on a foreclosure

For the buyer looking for a foreclosure, it is best to make your best offer the first time around. Sometimes it will come down not only to the banks bottom line but also your financing. Make sure you have your loan prequal before you start looking at homes. Most low priced homes will have several offers and usually above the asking price.

Mortgage Relief Act

CONGRESS PASSES MORTGAGE RELIEF ACT
Congress approved a bill offering tax relief to struggling homeowners Tuesday, paving the way for final signature by the President of the Mortgage Forgiveness Debt Relief Act of 2007. H.R. 3648 would eliminate the tax implication of mortgage debt relief. H.R. 3648 covers any mortgage debt relief from Jan. 1, 2007, and will continue to cover mortgage debt relief until Dec. 31, 2009. Additionally, H.R. 3648 will expand the tax deduction for private mortgage insurance (PMI) through Dec. 31, 2010.

FHA Moderniztion Bill

 SENATE PASSES FHA MODERNIZATION BILL
In a significant victory for REALTORS® and homeowners across the country, the U.S. Senate on Dec. 14 approved legislation designed to modernize the Federal Housing Administration's (FHA) mortgage insurance program by increasing loan limits and helping troubled borrowers with subprime loans refinance into federally insured mortgages. The Senate's approval followed an aggressive call to action by C.A.R. urging REALTORS® to contact Sen. Barbara Boxer seeking her support in passage of the bill.

The FHA Modernization Act, approved in a 93-1 vote, would increase loan limits for FHA-insured loans from $362,790 to $417,000, to mirror current conforming loan limits Fannie Mae and Freddie Mac may purchase. In addition, the Senate bill would allow the FHA to insure refinanced loans for borrowers who are delinquent on their mortgages due to ballooning payments on subprime loans.

Freddie Mac's Market Survey

McLEAN, VA - Freddie Mac released the results of its Primary Mortgage Market Surveyâ in which the 30-year fixed-rate mortgage (FRM) averaged 6.10 percent with an average 0.5 point for the week ending November 29, 2007, down from last week when it averaged 6.20 percent as well. Last year at this time, the 30-year FRM averaged 6.14 percent. The 30-year FRM has not been lower since the week ending October 13, 2005, when it averaged 6.03 percent.

The 15-year FRM this week averaged 5.73 percent with an average 0.5 point, down from last week when it averaged 5.83 percent. A year ago at this time, the 15-year FRM averaged 5.87 percent. The 15-year FRM has not been lower since the week ending January 26, 2006, when it averaged 5.70 percent.

Five-year Treasury-indexed hybrid adjustable-rate mortgages (ARMs) averaged 5.86 percent this week, with an average 0.5 point, down from last week when it averaged 5.88 percent. A year ago, the 5-year ARM averaged 5.95 percent. The 5-year ARM has not been lower since the week ending January 26, 2006 when it averaged 5.75 percent.

One-year Treasury-indexed ARMs averaged 5.43 percent this week with an average 0.7 point, up from last week when it was 5.42 percent. At this time last year, the 1-year ARM averaged 5.46 percent.

“Interest rates for U.S. Treasury securities have been drifting lower this month over market concerns that the housing slump and stress in the credit markets could slow future economic growth,” said Frank Nothaft, Freddie Mac vice president and chief economist. “As a result, interest rates for fixed-rate mortgages had room to slip lower this week. In addition to these concerns, the Federal Reserve also noted in its November 28th Beige Book that the glut of available homes continued, keeping downward pressure on prices and construction activity.”

“Add to this the S&P/Case-Shillerâ 20-composite index showing house prices falling 4.95 percent in the 12-months ending September, with 15 of the metropolitan areas showing annual declines and the overall picture does, indeed, appear glum with no immediate relief in sight.”

Since were near the end of the year I thought you might like some updated information on what has been going on in Shasta County. These are per the Shasta County MLS search information and does not include every home sold.

Single Family Homes not to include MFH

Rid hardwood floors of doggy scratch marks

Have dog's nails  left minor scratches in your wood floors?

A: If the scratches are not all the way through the finish and into the wood

below, there are a couple of things you can try:

1. Sand the scratched area with 0000-grade steel wool to blend the scratch

into the surrounding area.

2. Use a very small brush and apply a small amount of polyurethane just to

the scratch itself -- keep it off the surrounding area as much as possible.

Many hardwood floor companies also offer polyurethane scratch repair kits.

3. Rub a small amount of paste wax directly into the scratch, using a clean,

soft rag. Let the wax dry, then buff the area around the scratch. If you have

dark-colored floors, use a dark paste wax that's formulated for darker

woods.

4. Use a color-putty stick in a color that matches the floor. Rub it lightly into

the scratch, then let it dry.

5. Try one of the commercial scratch removers available that work primarily

by filling in the scratched area and eliminating the reflected light from that

area, making the scratch seem to disappear.

All of the products you need are available at most home centers, paint

stores or retailers of flooring-related products. Try the repair in an

unobtrusive spot such as a closet before tackling more obvious areas. If the

scratch is through the finish and into the wood beneath, you need to have

the area sanded and recoated. However, many hardwood floor contractors

can sand and coat just a portion of the floor, so it still may not be necessary

to do the entire floor.

Home Curb appeal checklist

Inspect the outside ground. Remove any building materials, scrap wood, discarded household items, etc. from the property. Store garbage cans in the garage.

Check the home from the roof line down.

Is the roof free and clear from obstructions and moss?
Are the gutters clear and neatly hung?
Are the windows clean and free from obstructions (such as overgrown bushes or trees)?
Are bushes, trees and shrubs neatly pruned?

Inspect the condition of the paint or siding?

Is it time to power wash the siding?
Is touch up paint needed?
Is the front door in good shape?

Do flower beds need an upgrade?

Are plants neatly pruned?
Is the bed free and clear of weeds?
Is the bed properly mulched?
Are flowers in bloom?

Keep the lawn neatly groomed.

Is the lawn free from weeds?
Is the lawn free from grass clippings?
Is the lawn neatly edged?
